1. Agreement to these terms

These Terms & Conditions apply to megancage.com, my email content, and the products and checkout pages I offer, including those hosted on systeme.io (together, the "Site"). They form an agreement between you and Megan Cage, LLC ("Megan Cage," "I," "me" or "my"). By using the Site or buying a product, you agree to these Terms and to my Privacy Policy. If you don't agree, please don't use the Site.

2. Who can use the Site

You must be at least 18, or the age of majority where you live, to buy products. By making a purchase, you confirm that the information you provide is accurate and that you're authorized to use your payment method.

3. My content and your license

Everything on the Site, including text, worksheets, workbooks, prompts, templates, graphics, branding and the MEGAN Test, belongs to me or is used with permission and is protected by copyright and trademark laws. I give you a limited, personal, non-transferable license to view the Site and to use any freebies or products you get for your own personal or internal business use.

You may not copy, resell, redistribute, share login or download links, upload to file-sharing or AI training tools, or create competing products from my materials without my written permission. Quoting a short excerpt with credit and a link back is welcome.

4. Digital products and purchases

Prices are listed in US dollars and may change, but a change won't affect an order you've already placed. Payments are processed securely through systeme.io and Stripe. You're responsible for any taxes or bank fees that apply to your purchase. After checkout, you'll receive access to your product by email or a download page. If something doesn't arrive, email me and I'll make it right.

5. Refunds

Because digital products are delivered instantly and can't be returned, all sales are final and I don't offer refunds, except where refunds are required by applicable law. If a file is missing, broken or doesn't match its description, contact me within 14 days of purchase and I'll fix it or send a replacement.

6. Results and earnings disclaimer

I share my own experiences, methods and numbers as I build in public. I can't promise that you'll achieve the same or any particular result. Figures like "$1K" describe an example milestone, not a typical or guaranteed outcome. Your results depend on your idea, effort, market, timing and many factors outside my control. Building a business involves risk, and you're responsible for your own decisions.

7. Not professional advice

The Site and my products are for educational and informational purposes only. They aren't legal, tax, accounting, financial or investment advice, and using them doesn't create a professional or client relationship. Talk to a qualified professional before making decisions in those areas, including keeping your side business compatible with your employment agreements.

8. AI tools and prompts

Some materials include prompts and suggestions for AI tools. AI output can be inaccurate, incomplete or similar to existing work. Review and fact-check anything it produces before you use or publish it. Don't enter confidential employer, client or personal information into AI tools. You're responsible for how you use AI and for the content you create with it.

9. Affiliate links and recommendations

I may recommend products, tools or travel I like, and some links may be affiliate links that pay me a commission at no extra cost to you. I'll only recommend things I actually use or believe in, and I'll disclose affiliate relationships where they apply.

10. Things you send me

When you send me a message, question, story or feedback, you confirm it doesn't violate anyone's rights. I may share anonymized versions in the Diary or my content. I won't publish your name or identifying details without your permission.

11. Acceptable use

Please don't use the Site to break the law, harass anyone, send spam, upload malicious code, scrape content in bulk, or try to get around security or payment systems. I may block access for anyone who does.

12. Third-party services and links

The Site relies on and links to services I don't control, including Squarespace, systeme.io, Stripe, Substack, Instagram and TikTok. Their own terms and policies apply when you use them, and I'm not responsible for their content, availability or practices.

13. Disclaimer of warranties

The Site and products are provided "as is" and "as available." To the fullest extent allowed by law, I disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. I don't guarantee the Site will always be available, error-free or secure.

14. Limitation of liability

To the fullest extent allowed by law, I won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Site or products. My total liability for any claim is limited to the amount you paid me for the product the claim relates to, or $100 if you didn't buy anything.

15. Indemnification

You agree to defend and hold me harmless from claims, losses and expenses, including reasonable legal fees, that arise from your misuse of the Site or products or your violation of these Terms.

16. Changes and termination

I may update these Terms from time to time and will change the date at the top when I do. Continuing to use the Site after an update means you accept the new Terms. I may suspend or end access to the Site or a product if these Terms are violated.

17. Governing law

These Terms are governed by the laws of the State of Illinois and applicable United States federal law, without regard to conflict-of-law rules. Any dispute that can't be resolved informally will be handled in the state or federal courts located in Illinois, unless the law where you live requires otherwise. If any part of these Terms is found unenforceable, the rest stays in effect.
